By accessing the Vinomatos, LDA – World Leaders in Mechanized Planting website, you agree to comply with these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with all applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this site are protected by applicable copyright and trademark laws.
2. Use License
Permission is granted to temporarily download one copy of the materials (information or software) on the Vinomatos, LDA – Líderes Mundiais na Plantação Mecanizada website for personal, non-commercial transitory viewing only. 7 – INFORMATION ABOUT PRODUCTS AND PRICES
7.1 – Product Information
Vinomatos, LDA – World Leaders in Mechanized Planting takes into account information regarding the essential characteristics of products through technical descriptions shared by its suppliers, and photographs that illustrate the products sold, in strict compliance with the best market standards.
7.2 – Pricing Information
The retail prices indicated via the requested quote or budget relating to the services/products of interest.
Shipping costs may be borne by the user and buyer and are added to the total value of the selected products. The user will be informed of these charges via the order form, quote, or invoice before confirming the order and completing the purchase process. Vinomatos, LDA – World Leaders in Mechanized Planting reserves the right to change prices at any time based on market volatility. However, Vinomatos, LDA – World Leaders in Mechanized Planting undertakes to apply the rates and prices indicated at the time of the quote or purchase request.
In the event of a computer, manual, technical, or any other error that causes a substantial change not foreseen by Vinomatos, LDA – World Leaders in Mechanized Planting in the retail price, such that it becomes exorbitant or manifestly ridiculous, the request for information for quotation or purchase will be considered invalid and cancelled.
8 – WARRANTY
The articles sold by Vinomatos, LDA – World Leaders in Mechanized Planting at www.vinomatos.com are covered by the legal guarantee regime, in accordance with the provisions of article 5 of Decree-Law no. 67/2003, of April 8, with amendments introduced by Decree-Law no. 84/2008, of May 21.
Returns due to transport damage – If the customer detects any anomaly or damage caused by the transport of the item they ordered, they must immediately report the incident to Vinomatos, LDA – World Leaders in Mechanized Planting.
For large volumes, upon receipt and unpacking, the customer must check for any visible damage that may have been caused during transportation. If the item is damaged in any way, it should not be accepted. After signing the shipping document, Vinomatos, LDA – World Leaders in Mechanized Planting is not responsible for any physical damage caused during transportation.
9 – RETURNS AND FREE RIGHT TO TERMINATE THE CONTRACT
The consumer has a period of 14 days, counting from the day on which he acquires physical possession of the goods or from the day on which he acquires physical possession of the last good, in the case of several goods ordered in a single order and delivered separately, to return his order, and without needing to indicate the reason.
10 – PRIVACY AND DATA PROTECTION POLICY
Vinomatos, LDA – World Leaders in Mechanized Planting respects the privacy of all website users and is committed to protecting the personal information each user chooses to share. Some sections and/or features of this website can be navigated without the user disclosing any personal information.
However, when it is necessary to collect personal information to provide services or when each user decides to provide some of their personal data, the use of that information and data will be carried out in compliance with the applicable legislation on personal data protection – Law 67/98 of 26 October, Data Protection Law – in order to ensure the confidentiality and security of the personal data provided.
The entity responsible for the collection and processing of personal data is Vinomatos, LDA – World Leaders in Mechanized Planting.
As part of customer data management, the personal data collected will be transmitted to third parties that are freight transport companies for the sole and exclusive purpose of fully realizing and executing the services or products purchased by the user, the holder of the personal data collected.
The provision of personal data is optional and the right to access, rectify and cancel any data provided will always be guaranteed, in accordance with the law. This right may be exercised in person or in writing, directly to the address of the registered office, as stated on the website’s homepage.
11 – BANK TRANSFER
You can request all the necessary payment details by email…
Orders paid by bank transfer are automatically canceled if they are not paid after 3 consecutive days.
12 – TRATAMENTO / ENVIO DE ENCOMENDAS
The entity responsible for the collection and processing of personal data is Vinomatos, LDA – World Leaders in Mechanized Planting.
All orders are sent by ctt expresso EMS19 (Mainland Portugal and Islands) or by EMS48 (Islands) from Monday to Friday;
Orders placed on weekends and national holidays will begin to be processed on the next business day;
Orders sent by EMS19 to mainland Portugal will be delivered by 7pm the next day (if it is a business day) after the order is shipped.
13 – EXCHANGES AND RETURNS
Vinomatos, LDA – World Leaders in Mechanized Planting is dedicated to offering the best experience to its customers. This extends to our customer service policy, where we strive to meet any and all customer needs. When ordering an item through our Online Store, the consumer is automatically covered by the Satisfaction Guarantee, allowing them to return or exchange an item within the first 14 days if it does not meet their expectations.
Before purchasing a product, bear in mind that when it comes to Contract Termination (Returns), Portuguese law contains elements that differentiate a remote purchase (online and to be received at the address via courier) from a purchase made/collected directly in a commercial space.
14 – TERMINATION OF CONTRACTS
(RETURNS) – REMOTE ORDERS
For distance purchases (online and to be received at the address via courier), Portuguese Law establishes a period of 14 days (commonly known as the reflection period) for the consumer after taking physical possession of the goods, during which they can return the item(s) without the need to indicate a reason.
In cases of free Contract Termination, return shipping costs are the responsibility of the consumer, as stipulated in paragraph 2 of article 13 of Decree-Law no. 24/2014, of 14 February.
15 – CONDITIONS OF ACCEPTANCE, RETURNS / EXCHANGES
Although returns/exchanges are accepted within the first 14 days for distance purchases (as described above), returned goods will only be accepted if they scrupulously comply with the following conditions:
15.1. The returned item must be intact and without any signs of wear/damage.
15.2. You must return the item along with its packaging, manuals and accessories in an undamaged condition.
15.3. Along with the returned item, you will need to include the invoice showing the item.
If any of these points are violated, we will not be able to accept the return (and subsequent refund) or exchange.
In cases of free Contract Termination, return shipping costs are the responsibility of the consumer, as stipulated in paragraph 2 of article 13 of Decree-Law no. 24/2014, of 14 February.
16 – REFUND AND RETURNS METHODS
If you require a refund, it will be processed via bank transfer to the IBAN number you provide when you request the return. Vinomatos, LDA – World Leaders in Mechanized Planting will refund the amount paid for the item once the product’s condition has been technically inspected and the conditions described above have been met.
